Dale Marshall is a highly experienced criminal defense lawyer based in Victoria, Canada. Having practiced law for over three decades, Dale has successfully defended individuals charged with a wide range of criminal offenses, including drug offenses, driving offenses, assault-related offenses, and homicide. He has also been lead counsel on several high-profile cases resulting in acquittals or reduced charges. Dale’s extensive experience and reputation in the courts and Crown Office make him an ideal representative for anyone facing criminal charges. He is well-versed in the BC Provincial Court, BC Supreme Court, and the BC Court of Appeal.
Dale is known for his compassionate approach to criminal defense. He understands the stress that comes with being accused of a crime, not only for the accused but also for their families. He works tirelessly to guide his clients through the complicated Criminal Justice System with expertise and understanding.
Outside of his legal practice, Dale is an accomplished educator and community volunteer. He has taught Criminal Procedure at the University of Victoria Law School and regularly speaks at local High School law classes and community groups. Dale is also a family man who enjoys spending time with his loved ones. He has played and coached various sports in Victoria for several decades and still enjoys spending time on the golf course and ice rink. Dale is now enjoying his time umpiring youth fastpitch while learning the challenges of being on the other side.

Chris Massey has over two decades of experience as a criminal trial lawyer. He has successfully litigated cases at every level of court in British Columbia as well as the Supreme Court of Canada. Chris has experience defending against all manner of criminal charges, including drug offences, allegations of violence, financial crimes, driving offences, and homicide.
Chris’s practice also includes a focus on professional discipline. He has assisted doctors, nurses, accountants, teachers, pharmacists, public servants, and many other professionals to navigate their way through employment-related allegations that threaten their reputation and livelihood. Chris has successfully guided clients through regulatory body investigations, workplace and public sector investigations, and public Commissions of Inquiry.
Chris is one of only a few lawyers in British Columbia with extensive experience assisting pharmacies in responding to PharmaCare audits. His detailed approach and familiarity with pharmacy practice has achieved significant financial savings for many clients facing staggering potential recovery figures following an audit.
In addition to his practice, Chris teaches Trial Advocacy as a sessional instructor at the University of Victoria Faculty of Law.

Roberto Alberto spent his early years in El Salvador, immigrating to Canada in 1984 due to violence and unrest in his home country. He has lived and worked in Victoria ever since. Roberto is a passionate community volunteer with a diverse academic background, holding degrees in Applied Chemistry and Biology from Camosun College, and Biochemistry and Microbiology with a minor in Biology from the University of Victoria. Fluent in English and Spanish, Roberto is one of few lawyers registered with the Attorney General of British Columbia to notarize and authenticate bilingual documents for international use.
As a young man, Roberto excelled in competitive soccer, winning local and provincial championships. This experience shapes his teamwork and leadership skills to this day. Before, during, and after attending the University of Victoria Law School, Roberto led projects supporting disenfranchised individuals and addressing the systemic issues that target the most vulnerable in our society.
Since his call to the Bar, Roberto focused on criminal law and child protection. He has run hundreds of cases, ranging from minor offences to complex ones like attempted murder, sexual offences, and serious drug cases. Notably, he has successfully challenged the constitutionality of mandatory minimum sentences in sexual assault cases. Roberto is, since 2013, a member of the Criminal Duty Counsel Roster and, since 2016, a member of the Justice Access Centre’s Duty Counsel Team.
Roberto is a sessional instructor at the University of Victoria, teaching Criminal Procedure and coaching the Criminal Advocacy Moot Team. He supervises students at the university’s legal clinic, sharpening his advocacy skills while mentoring future trial lawyers. Outside the firm, Roberto has held various roles, including Adjudicator, Ombudsperson Executive Assistant, and most recently ad-hoc Crown Counsel acting for the federal government on niche legal issues.

Owen James is an associate lawyer at Marshall Massey & Alberto. He has appeared in British Columbia’s Supreme Court, Provincial Court, and Court of Appeal. Owen has practiced in Victoria since his call to the Bar, working primarily in criminal law, but also taking on select family law cases. His clients have been acquitted at trial of serious charges including aggravated assault, possession for the purpose of trafficking, unlawful confinement, and sexual assault.
During Owen James’s studies at the University of Victoria Law School, he focused on criminal law, taking every course he could on the subject. He represented the University at the Macintyre Cup, a criminal trial advocacy moot, where his team placed third. Owen was recognized for delivering the best closing submissions in the competition. Owen James also volunteered his time with the Pro Bono Students of Canada, working on several projects, and was a founding member and vice-president of the Sports and Entertainment Law Club.
At UVIC, Owen had the privilege of taking Criminal Procedure from the senior partner at Marshall Massey Alberto, Dale Marshall. After his studies were complete, Owen articled at the firm, and returned full-time as an associate after his qualification exams.
Focusing his practice nearly exclusively on criminal law has accelerated Owen’s experience in all aspects of this area of law, including appeals, trials, bail hearings, sentencings, IRP reviews, traffic tickets, relocation hearings, firearms seizure applications, preliminary inquiries, and much more. Owen can be found in the Victoria, Nanaimo, Western Communities, and Duncan law courts on an almost daily basis.
When Owen is not in court, he can usually be found renovating his house, at the gym, or being walked by his two Rottweilers, Nero and Caligula.

Declan has been with the firm since his articling term in 2023 and joined the firm as an associate lawyer in September 2024. He completed a Bachelor of Arts in English and History with distinction at the University of Calgary and obtained his law degree at the University of Victoria. While at law school, Declan participated in the Macintyre Cup, a criminal trial advocacy moot, where he received an award for Best Closing Submissions.
Declan’s primary area of practice is criminal defence. His compassion, knowledge of the law, and confident, energetic advocacy help him to achieve the best possible resolution for his clients. He understands that when someone has been charged with a crime, their legal proceeding often becomes the most stressful and challenging experience of their life. Whether a client wants to prove their innocence at trial or admit fault and negotiate with the Crown, Declan will be always be a zealous advocate.
Declan can also help with traffic ticket disputes and IRP reviews.
Prior to becoming a lawyer, Declan worked as an English teacher and a bartender in Alberta, BC, and Vietnam. He is passionate about sports, and currently plays Division 1 soccer for Bays United, and has coached youth soccer and high school football teams.
